These Terms and Conditions ("Terms") govern your use of Equinova's luxury car rental services. By booking a rental or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Definitions

In these Terms, the following definitions apply:

  • "Service" refers to Equinova's luxury car rental offerings
  • "Vehicle" means any automobile provided by Equinova for rental
  • "Renter" or "You" refers to the individual or entity renting the Vehicle
  • "We," "Us," or "Our" refers to Equinova
  • "Rental Period" means the time window specified in your booking confirmation
  • "Agreement" refers to these Terms together with your rental booking

2. Eligibility Requirements

To rent a Vehicle from Equinova, you must:

  • Be at least 25 years of age
  • Hold a valid driver's license (Singapore or International Driving Permit)
  • Have a minimum of 2 years driving experience
  • Provide valid identification (NRIC, passport, or approved government ID)
  • Present a valid credit card for security deposit purposes
  • Have legal capacity to enter into binding contracts

We reserve the right to verify your eligibility and refuse service if these requirements are not met.

3. Booking and Reservations

3.1 Booking Process

Reservations can be made through our website, phone, or email. All bookings are subject to vehicle availability and our approval. We recommend booking at least 48 hours in advance to ensure availability.

3.2 Booking Confirmation

Upon successful booking, you will receive a confirmation email containing rental details, pricing, pickup/delivery information, and these Terms. Please review all details carefully.

3.3 Modifications

Booking modifications must be requested at least 24 hours before the scheduled rental start time. We will accommodate changes subject to vehicle availability and may apply modification fees.

4. Pricing and Payment

4.1 Rental Fees

Rental fees are quoted in Singapore Dollars (SGD) and include:

  • Vehicle rental for the specified time window
  • Comprehensive insurance coverage
  • Specified mileage allowance
  • Service amenities as described for each tier
  • Delivery and collection within central Singapore

4.2 Additional Charges

Additional fees may apply for:

  • Mileage exceeding the included allowance
  • Late return fees (SGD 150 per hour)
  • Fuel replacement if not returned with equivalent level
  • Cleaning fees for excessive dirt or damage
  • Traffic violations or parking fines incurred during rental
  • Damage to the Vehicle not covered by insurance

4.3 Security Deposit

A security deposit of SGD 2,000-5,000 (depending on vehicle category) will be pre-authorized on your credit card. This deposit is released within 7-14 business days after rental completion, provided no additional charges apply.

4.4 Payment Terms

Full payment is required at the time of booking. We accept major credit cards (Visa, MasterCard, American Express). Payment must be made by the primary renter whose name appears on the booking.

5. Cancellation and Refund Policy

  • More than 48 hours before rental: Full refund
  • 24-48 hours before rental: 50% refund
  • Less than 24 hours before rental: No refund

Cancellations made within 24 hours may be eligible for credit toward future rentals if you contact us directly. This policy applies to standard cancellations; different terms may apply for force majeure events.

We reserve the right to cancel bookings due to vehicle unavailability, weather conditions, or other unforeseen circumstances. In such cases, you will receive a full refund.

6. Vehicle Use and Restrictions

6.1 Permitted Use

The Vehicle may only be used for lawful purposes on properly maintained roads within Singapore and approved areas of Johor Bahru, Malaysia (when pre-authorized). You must operate the Vehicle in accordance with all traffic laws and regulations.

6.2 Prohibited Activities

You must not:

  • Use the Vehicle for commercial purposes (delivery, ride-sharing, racing)
  • Allow unauthorized persons to drive the Vehicle
  • Transport illegal substances or engage in illegal activities
  • Exceed passenger capacity or towing limits
  • Smoke in the Vehicle (SGD 500 cleaning fee applies)
  • Transport pets without prior authorization
  • Drive under the influence of alcohol or drugs
  • Use the Vehicle on unpaved roads or in hazardous conditions

6.3 Authorized Drivers

Only the primary renter and additional drivers listed on the rental agreement may operate the Vehicle. All drivers must meet our eligibility requirements and be approved in advance.

7. Insurance and Liability

7.1 Insurance Coverage

All rentals include comprehensive insurance covering third-party liability and vehicle damage. Coverage is provided by AXA Singapore and includes:

  • Third-party bodily injury and property damage
  • Vehicle collision and theft protection
  • 24-hour roadside assistance

7.2 Insurance Exclusions

Insurance does not cover damage or loss resulting from:

  • Prohibited use or violations of these Terms
  • Driving under the influence
  • Unauthorized drivers
  • Intentional damage or gross negligence
  • Personal belongings left in the Vehicle

7.3 Renter Liability

You are responsible for any damage to the Vehicle during the rental period not covered by insurance, including the insurance deductible. You must report all accidents, damage, or theft to us and the police immediately.

8. Vehicle Condition and Inspection

At delivery, you will conduct a visual inspection of the Vehicle with our representative. Any pre-existing damage will be documented. You agree that the Vehicle is in good condition unless noted otherwise. Failure to report damage at pickup may result in responsibility for that damage.

Upon return, we will inspect the Vehicle for damage or excess wear. You should be present during this inspection when possible.

9. Breakdown and Accidents

9.1 Roadside Assistance

If the Vehicle breaks down or requires assistance, contact our 24-hour support line immediately. We will arrange roadside assistance or a replacement vehicle.

9.2 Accidents

In case of an accident:

  • Ensure safety of all parties involved
  • Contact police if required by Singapore law
  • Notify Equinova immediately
  • Exchange information with other parties
  • Do not admit liability
  • Complete an accident report form

Failure to report accidents or follow proper procedures may void insurance coverage.

10. Termination of Rental

We reserve the right to terminate the rental and repossess the Vehicle without notice if:

  • You violate any provision of these Terms
  • The Vehicle is being used illegally or improperly
  • Payment obligations are not met
  • The Vehicle poses a safety risk
  • False information was provided during booking

No refund will be provided for terminations due to renter violations.

11. Limitation of Liability

To the maximum extent permitted by Singapore law:

  • Equinova is not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the rental fees paid for the relevant booking
  • We are not responsible for delays caused by traffic, weather, or other factors beyond our control
  • You use the Vehicle at your own risk

This limitation does not affect your statutory rights under Singapore consumer protection laws.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Singapore. Any disputes will be subject to the exclusive jurisdiction of Singapore courts.

12.2 Informal Resolution

13. General Provisions

13.1 Entire Agreement

These Terms, together with your booking confirmation, constitute the entire agreement between you and Equinova regarding your rental.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

13.3 Amendment

We may update these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of updated Terms.

13.4 Waiver

Our failure to enforce any provision does not waive our right to enforce that provision in the future.
